Terms of Service

1. Acceptance of Terms

By accessing or using LegacyLens (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

LegacyLens is a family photo sharing and preservation platform that provides:

  • Photo storage and organization through albums
  • AI-powered face detection and recognition
  • Collaborative album sharing with family members
  • Legacy planning for digital photo inheritance

3. Account Registration

To use the Service, you must create an account by providing a valid email address, display name, and password. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Ensuring your account information is accurate and current

You must be at least 13 years of age to create an account. By creating an account, you represent that you meet this age requirement.

4. User Content

4.1 Ownership

You retain all ownership rights to the photos and content you upload to the Service (“User Content”). LegacyLens does not claim ownership of your User Content.

4.2 License Grant

By uploading User Content, you grant LegacyLens a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the Service to you. This includes generating thumbnails, extracting EXIF metadata, detecting faces, and creating face embeddings for recognition purposes.

4.3 Content Restrictions

You agree not to upload content that:

  • Violates any applicable law or regulation
  • Infringes on the intellectual property rights of others
  • Contains malware, viruses, or harmful code
  • Is obscene, defamatory, or constitutes harassment
  • Contains content depicting the exploitation of minors

5. Subscription Plans and Billing

5.1 Free Tier

The free tier (“Memory Starter”) includes limited storage, basic face detection, and a restricted number of albums and family profiles.

5.2 Paid Plans

Paid subscription plans provide additional storage, advanced face identification, unlimited family profiles, and legacy planning features. Subscriptions are billed on a monthly or annual basis. You may cancel your subscription at any time, and your paid features will remain active until the end of the current billing period.

5.3 Refunds

Refunds may be issued at our discretion within 14 days of initial purchase. No refunds will be provided for partial billing periods after the 14-day window.

6. Sharing and Collaboration

You may invite other users to collaborate on albums. When you share an album, collaborators gain access based on the role you assign:

  • Viewer: Can view photos in the album
  • Contributor: Can view and add photos to the album
  • Owner: Full control including managing access and deleting photos

You are responsible for managing who has access to your albums and the roles assigned to collaborators.

7. Legacy Planning

The Legacy Planning feature allows you to designate contacts (“Legacy Keepers”) who may receive access to your photo collection after a period of account inactivity. By configuring Legacy Planning, you acknowledge that:

  • Transfers are initiated only after the inactivity period you configure
  • We will attempt to contact you before executing any transfer
  • You may modify or revoke legacy designations at any time while your account is active
  • Legacy Keepers will receive access to album content but not your account credentials

8. Face Recognition

By using the face recognition features of the Service, you acknowledge and agree that:

  • Face data (bounding boxes and embedding vectors) will be generated from your photos
  • You have the consent of individuals whose faces appear in your photos, or have a lawful basis for processing this data
  • Face data is processed solely within your account and is not shared across users
  • You may delete face profiles and their associated data at any time

9. Prohibited Uses

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the integrity of the Service
  • Upload content exceeding your plan's storage limits
  • Use automated tools to scrape, crawl, or extract data from the Service
  • Create multiple accounts to circumvent plan limitations
  • Share your account credentials with others
  • Use the face recognition features for surveillance or non-personal purposes

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or experience outages that temporarily limit access. We will make reasonable efforts to notify users in advance of planned downtime.

11. Termination

You may terminate your account at any time by contacting us or through the account settings. We may suspend or terminate your account if you violate these Terms. Upon termination:

  • Your access to the Service will be revoked
  • A 30-day recovery period is provided, during which your data is preserved
  • After the recovery period, all data is permanently deleted
  • Any active subscriptions will not be renewed

12. Limitation of Liability

To the maximum extent permitted by law, LegacyLens and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

13. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, secure, or available at all times. Face recognition accuracy may vary and we do not guarantee specific detection or identification rates.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
